GOVERNING LAW

This Agreement shall be governed by and construed in accordance with the laws of the State of Kentucky, without giving effect to any principles of conflicts of law. Nothing in these Terms shall be deemed to waive any applicable consumer protection laws. You irrevocably agree to submit to the personal and exclusive jurisdiction of the state and federal courts located within Fayette, Kentucky for the resolution of any dispute arising from or relating to these Terms or your use of the Website. You waive any objection to venue in these courts and agree not to plead or claim in any such court that such proceeding brought therein has been brought in an inconvenient forum.

DISPUTE RESOLUTION

Prior to initiating any legal proceeding (except for actions seeking injunctive relief), any dispute, controversy, or claim arising out of or relating to these Terms or the Website shall first be subject to mandatory informal dispute resolution. The complaining party must send written notice of the dispute to the other party, describing the dispute in reasonable detail. If the dispute remains unresolved after this period, either party may pursue all legal remedies available under applicable law. Nothing in this section shall prevent either party from seeking immediate injunctive relief if necessary to protect its rights or property. 

WAIVER

No waiver of any provision of these Terms of Use by Dope Magic Co shall be deemed, or shall constitute, a waiver of any other provision, nor shall any failure by Dope Magic Co to enforce any provision of these Terms of Use at any time be construed as a present or future waiver of any of the provisions of these Terms of Use, nor in any way affect the validity of Dope Magic Co's right to enforce each and every such provision at any and all times thereafter.

EFFECT OF HEADINGS 

The subject headings of the paragraphs and subparagraphs of these Terms of Use are included for convenience and shall not affect the construction or interpretation of any of its provisions.

ENTIRE AGREEMENT

These Terms of Use, together with our Privacy Policy and any additional terms to which you agree when using particular elements of the Website, constitute the entire agreement between you and Dope Magic Co and supersede all prior or contemporaneous communications, understandings, and agreements, whether oral or written, between you and Dope Magic Co with respect to the subject matter hereof.
